President William Ruto wants to borrow 20 billion from World bank and the European Union to be borrowed by Hustlers Fund kitty that has a default rate of 92% besides the allocation of 10B in the 2023-2024 budget according to lobby group operation Linda Jamii.
Recent Statistics point to a default of Ksh. 3 billion in 9 Months. Operation Linda Jamii Submitted a petition at the Supreme court Last year Calling for oversight and accountability of the funds which came as a campaign Promise appearing to effectively do away with youth fund, Uwezo and Women Enterprise funds, which at a legal frameworks to protect them as opposed to
Hustler fund which has no legal backing.

The Government of Kenya through Legislative Supplement No. 91 dated 23rd day of November, 2022 appropriated Kshs. 50 billion through a supplementary appropriation to the micro, small and medium-sized enterprises (MSMEs) as well as individuals and has up to and until the time of filing of this Petition disbursed Kshs. 12.5billion and continues to disburse other funds.
The said Hustler Fund, according to the Government of the Republic of Kenya through Dr. David Ndii, the Chairperson of the Presidents Council of Economic Advisors is run and managed by some undisclosed private sector members despite the Government of Kenya expending public finances through supplementary appropriations under Article 223 of the Constitution of Kenya to operationalize the Fund.
Additionally, the lack of public participation in the delineation of the Members of private sector to manage and run the fund, an expenditure on public finance, worsens the infringements on the Constitution which the Court should adress.
Under the certificate of Urgency, the court will issue direction on the case today.
